Terms and Conditions of Use of the Loodu Online Shop

The owner of the loodu.ee online shop (hereinafter referred to as the Online Shop) is Loodu OÜ (registry code 14992146), located at Raudtee 64 11617 Tallinn, Estonia.

Term of sales contract and information on goods and prices

The sales terms apply to the purchase of goods from the Online Shop. The prices of the goods sold in the Online Shop are indicated next to them. A fee for delivery of the goods is added to the price. The delivery fee depends on the location of the purchaser and the delivery method. The delivery fee will be displayed to the purchaser when placing an order. Information about the goods is provided in the Online Shop next to the goods.

Placing an order

To order goods, the requested goods should be added to the shopping basket. To place an order, you must fill in the required fields and select the appropriate delivery method. The final cost is then displayed on the screen, which can be paid by bank transfer or another payment method. The sales contract will enter into force as soon as the amount due has been credited to the account of the Online Shop. If the ordered goods cannot be delivered due to expiry of the goods or for any other reason, the purchaser will be notified as soon as possible and the money paid (including the delivery fees) will be refunded immediately but no later than 14 days after sending the notice.

Delivery

The goods may be sent to the following countries: Estonia, Latvia, Lithuania, Finland, Sweden. Shipping costs are borne by the purchaser and the corresponding price information is displayed next to the shipping method. Shipments within Estonia usually arrive at the destination within 3-7 working days of the date of entry into force of the sales contract. Outside Estonia, delivery will take place within 21 calendar days. In exceptional cases, the right of delivery is granted up to 45 calendar days.

Right of withdrawal

Once the order has been received, the purchaser has the right to withdraw from the contract entered into in the Online Shop within 14 days. The right of withdrawal does not apply if the purchaser is a legal person. In order to exercise the right of withdrawal within 14 days, the goods ordered may not be used in any other way than is necessary to ascertain the nature, properties and functioning of the goods, in the same way as is allowed for testing the goods in a physical shop. If the goods have been used for purposes other than those necessary to ascertain the nature, properties and functioning of the goods, or if the goods show signs of use or wear, the Online Shop has the right to reduce the refundable amount in accordance with the reduction in the value of the goods. In order to return the goods, an application of withdrawal from the purchase of the goods must be submitted and sent to the Online Shop’s e-mail address no later than 14 days after receiving the goods. The costs of returning the goods is borne by the purchaser, unless the reason for returning the goods is due to the fact that goods to be returned do not correspond to what was ordered (e.g. wrong or defective goods). The purchaser must return the goods within 14 days of the date of the application or provide proof that they have handed the goods over to the carrier within the aforementioned period. Upon receipt of the returnable goods, the Online Shop will reimburse the purchaser immediately, but no later than 14 days after the receipt of the withdrawal application, all the payments received from the purchaser under the contract. The Online Shop may refuse to make refunds until it has received the goods that are the subject of the contract or until the purchaser has provided proof that they have returned the goods, whichever happens earlier. If the purchaser has explicitly chosen a delivery method other than the cheapest delivery method offered by the Online Shop, the Online Shop does not have to reimburse the consumer for the cost that exceeds the cost of the usual delivery method.

The Online Shop has the right to withdraw from the sale and demand the return of the goods if the price of the goods in the Online Shop is marked significantly below its market price due to a mistake.

Right to lodge a complaint

The Online Shop is responsible for the non-conformity or defect of the goods sold to the purchaser which existed at the moment of delivery and which occurs within two years from the delivery of goods to the purchaser. During the first six months after the delivery of the goods to the purchaser, the defect is presumed to have existed at the time of delivery. It is the responsibility of the Online Shop to rebut this presumption. In the event of a defect, the purchaser has the right to contact the Online Shop within two months at the latest by sending an e-mail to info@loodu.ee or by calling 5349 9762. The Online Shop is not responsible for defects that occur after the goods have been delivered to the purchaser. If the goods purchased from the Online Shop have defects for which the Online Shop is responsible, the Online Shop will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Shop will refund the purchaser all the fees associated with the contract of sale. The Online Shop responds to the complaint submitted by the consumer in writing or in a form that can be reproduced in writing within 15 days.

Direct marketing and processing of personal data

The Online Shop uses personal data provided by the purchaser (including name, telephone number, address, e-mail address, bank details) only for processing the order and sending the goods to the purchaser. The Online Shop forwards personal data to companies providing transport services in order to deliver the goods. The Online Shop will send newsletters and offers to the purchaser’s e-mail address only if the purchaser has expressed this wish by entering their e-mail address on the website and has indicated the wish to receive direct mail notifications. The purchaser may cancel the offers and newsletters sent to their e-mail address at any time by notifying us by e-mail or following the instructions given in the e-mail which contains offers.

Resolution of disputes

If the purchaser has any complaints regarding the Online Shop, they should contact the Online Shop by sending an e-mail to info@loodu.ee or calling +372 5349 9762. If the purchaser and the Online Shop cannot resolve the dispute by agreement, the purchaser can turn to the Consumer Disputes Committee. The Consumer Disputes Committee is competent to settle disputes arising from a contract concluded between the purchaser and the Online Shop. The review of the purchaser’s complaint in the Committee is free of charge. The purchaser may turn to the European Union Online Dispute Resolution Platform.
